Solicitation Permits

FAQ

    • Canvasser means any person whose primary purpose is to enlist support for or against a particular religion, philosophy, ideology, political party, issue, or candidate.
    • Peddler means any person who carries goods, wares, merchandise or personal property with them and offers it for sale for a purely commercial purpose.
    • Solicitor means any person who takes orders for goods for future delivery, or for services to be performed in the future, including requesting contribution of funds or selling goods or services for a non-commercial purposes.
  • Canvasser—No
    Peddler and Solicitor—Yes

    • A valid Texas Driver’s License or state issued photo identification.
    • The number of the limited sales tax permit issued to the business by the state comptroller’s office, if applicable.
    • A brief description of the activity or business to be conducted.
    • The appropriate fee.
    • Proof of status necessary to receive an exception under Section 28-11 or 28-16 of the Abilene City Code.
    • Solicitations are being made upon premises owned or occupied by an organization upon whose behalf the solicitation is made (example: such as a church soliciting those attending the church on their own property)
    • Any solicitation in the form of a collection at a regular meeting, assembly, or service of a charitable person
    • A solicitor or peddler is already licensed by the state to engage in the activity (must provide proof)
    • A permit must be obtained by the organization sponsoring any minor solicitation.
    • The sponsor shall be responsible for all minors under the permit.
    • Each minor soliciting under the permit must  have identification provided by the sponsor that identifies the name of the sponsor
    • 30 day permit   $ 50.00
    • Fee for each additional worker/solicitor   $ 10.00
    • Yearly application (local business only)   $ 100.00
    • Yearly fee for additional worker/solicitor   $ 10.00


    Exceptions To The Fee
    - Permit fees are not required for religious groups, charities, farmers’ market, and educational organizations.

  • Upon completion of the application, the city licensing officer shall issue a permit to the applicant within five (5) business days, unless grounds for denial exist.

Prohibitions

  • City of Abilene Amended Solicitation Ordinance (#63-2013)

    No solicitor, peddler, or canvasser may locate in the roadway which includes the areas adjacent to or nearby the traveled portion of the road at any of the following locations:

    • All intersections, access roads, and ramps adjacent to Winters Freeway from S. 1st Street to Buffalo Gap Road
    • All intersections adjacent to:
    • Buffalo Gap Road from S. 27th to Antilley Road
    • Southwest Drive from Winters Freeway to Catclaw Drive
    • Business I-20 from US-83 (Winters Freeway) to N. Judge Ely Blvd.
    • S. 14th Street from Willis Street to Butternut Street
    • Judge Ely Blvd. from ES 11th Street to EN 10th Street
    • Ambler Ave./SH 351 from Grape Street to East Lake Road
    • Treadaway Blvd. from E. Hwy 80 to S. 11th Street
    • Treadaway Blvd. from S. 27th Street to Industrial Blvd

    No solicitor, peddler, or canvasser may locate in the median or traffic island of any street or roadway.

  • Aggressive manner means:

    (a) Making any physical contact with or touching another person in the course of the solicitation without the person's consent

    (b) Touching, tapping or hitting any part of a motor vehicle occupied by a person being solicited unless such touching is with the express permission of the occupant

    (c) Blocking the safe or free passage of the person being solicited or requiring the person, or the driver of a vehicle, to take evasive action to avoid physical contact with the person making the solicitation

    (d) Using obscene or abusive language or gestures toward the person being solicited

    (e) Approaching the person being solicited in a manner that is:

    1. Likely to cause a reasonable person to fear imminent bodily harm or the commission of a criminal act upon property in the person's possession; or

    2. Reasonably likely to intimidate the person being solicited into responding affirmatively to the solicitation.

    (f) Following the person being solicited in a manner that is:

    1. Likely to cause a reasonable person to fear imminent bodily harm or the commission of a criminal act upon property in the person's possession; or

    2. Reasonably likely to intimidate the person being solicited into responding affirmatively to the solicitation;

    (g) Continuing to solicit a person after the person has made a negative response.

    When are the hours of solicitation?

    9:00 AM until 7:00 PM

    Signage

    It shall be unlawful for any person to canvass, solicit, or peddle upon any private property in the City where the owner, occupant, or person legally in charge of the premises has posted at the entry to the premises, or at the entry to the principal building on the premises, a sign bearing the words "No Peddlers", "No Solicitors", or words of similar import.
